The new opinions from the Virginia Supreme Court came out Friday and can be found here. Two decisions of interest are Nusbaum v. Berlin and Doherty v. Aleck. In Nusbaum, a trial court held an attorney in criminal contempt for shoving an opposing attorney at a jury trial. The Supreme Court upheld the finding of criminal contempt and the associated fine, but not the lower court's assessment of the opposing side's attorneys fees and costs. In Doherty, the Court reinstated a jury verdict in a medical malpractice action against a podiatrist.
